A. Terms of Use for Users

Only the following Terms of Use shall apply between Messe Düsseldorf GmbH, Stockumer Kirchstrasse 61, 40474 Düsseldorf, Germany, and the user who utilises the website offered here.
All rights are reserved by Messe Düsseldorf GmbH. No rights of use of any kind are granted. Reproduction is permitted for private use only.
Messe Düsseldorf GmbH offers users the opportunity to find out about the services provided by Messe Düsseldorf GmbH and its exhibitors. Messe Düsseldorf GmbH reserves the right to amend or remove information at any time. The information is provided without guarantee.

Registration/Data Protection

  1. Messe Düsseldorf GmbH reserves the right to grant access to certain areas only to those users who have agreed to the applicable specific terms and conditions (e.g. any service charges that may apply) and who have registered with Messe Düsseldorf GmbH.
  2. The user undertakes to provide truthful, accurate, complete and up-to-date information, as required on the registration form provided by Messe Düsseldorf GmbH, for the purposes of any registration that may be required.
  3. The User’s personal data will only be processed in accordance with the statutory provisions of the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG).

Responsibility/Liability

  1. Messe Düsseldorf GmbH expressly points out that it is not responsible for the information provided by exhibitors on and via this internet portal. This applies to all possible breaches of law and legal violations. It is pointed out that this information does not constitute content provided by Messe Düsseldorf GmbH, nor does the company endorse such content. The respective exhibitors have indemnified Messe Düsseldorf GmbH against any liability in this regard.
  2. Should the user enter into transactions with the exhibitors (e.g. concluding contracts or making payments), this does not give rise to any legal relationship between Messe Düsseldorf GmbH and the user. Any such relationship is established exclusively between the user and the exhibitor. 

Note

The logos, emblems and content displayed on and behind the portal page may be protected by law, either in whole or in part. This applies in particular to trade mark and patent rights, but also to all other forms of intellectual property rights.
Should the user wish to use (reproduce, modify, etc.) such symbols, logos or content from the portal, they must first obtain permission from the respective rights holder.

Final provisions

  1. The use of the internet portal, as well as the internet portal itself, is governed by the law of the Federal Republic of Germany.
  2. The place of jurisdiction and place of performance shall be Düsseldorf, insofar as this can be agreed between the parties.
  3. Should one or more provisions of these General Terms and Conditions be or become invalid, this shall not render the entire contract invalid. The invalid provision shall be replaced by the relevant statutory provision.

B. Terms of Use for Exhibitors

Subject Matter of the Contract

The following Terms of Use apply to exhibitors of Messe Düsseldorf GmbH, Stockumer Kirchstrasse 61, 40474 Düsseldorf, Germany, who use the internet portal set up by Messe Düsseldorf
GmbH for their own purposes (e.g. advertising, customer service, concluding contracts, etc.). Via the GIFA portal, Messe Düsseldorf GmbH offers exhibitors the usage options defined in the scope of services, as well as the option to order services online via the online ordering system (OOS).   
                                            
Exclusive applicability of the Terms of Use

The following Terms of Use apply exclusively in connection with these services:

Access

Once the exhibitor has been approved by Messe Düsseldorf GmbH, a password and a user ID will be sent to the exhibitor by post. The exhibitor must treat the password and user ID as confidential and protect them from access by or disclosure to third parties. The exhibitor is responsible for all actions carried out using the password and/or user ID. They are obliged to inform Messe Düsseldorf GmbH immediately if the password and/or user ID has been used without authorisation.

Scope of services

  1. The internet portal operated by Messe Düsseldorf is generally available to the exhibitor and their customers 24 hours a day, every day of the year.
  2. The exhibitor is able at any time to: a) enter and update their company details; b) provide their company contact details; c) upload their company logo; d) offer customers appointment slots to visit their stand at the in-person trade fair; e) post job vacancies and job applications; f) place orders for services (in the OOS section).
  3. The display of company details or products is permitted only to the extent that the services cannot be confused with those of Messe Düsseldorf GmbH.
  4. All rights to titles and trade marks are held by Messe Düsseldorf GmbH. Rights of use of any kind are not transferred by virtue of the opportunity to have a presence on the portal.
  5. Messe Düsseldorf GmbH is entitled to suspend the portal (even at short notice) for operational and/or technical reasons. Messe Düsseldorf GmbH accepts no liability for damage arising from technical faults – e.g. in the event of a server connection failure – incorrect transmission and/or force majeure.
  6. The exhibitor agrees that Messe Düsseldorf may publish information and press releases via the portal and the associated service in which the exhibitor’s name is mentioned.

Registration/Data Protection

  1. The exhibitor is entitled to use the service in accordance with the scope of services. This requires the exhibitor to register. Furthermore, the standard terms and conditions of Messe Düsseldorf GmbH (
    ) (e.g. terms and conditions of participation; the relevant terms and conditions governing the ordering and provision of services) also apply online with regard to these usage options.
  2. The exhibitor undertakes to provide truthful, accurate, complete and up-to-date information for the registration process, as required on the registration form provided by Messe Düsseldorf GmbH.
  3. The exhibitor’s personal data will be processed in accordance with the statutory provisions of the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG).
  4. The exhibitor agrees that Messe Düsseldorf GmbH may contact them in various ways (e.g. by sending a newsletter).

Data security

  1. The exhibitor is aware that data and information sent online can be viewed and tampered with.
  2. The exhibitor is aware that all data transmitted via the internet may be intercepted, modified or destroyed by third parties. The exhibitor is solely responsible for implementing adequate security and protection measures. This applies in particular to the protection of the exhibitor’s own system, the accuracy of data input and output, and the security of the exhibitor’s own data. Messe Düsseldorf GmbH accepts no liability in this regard.


Liability Data Protection

The exhibitor undertakes to comply with and monitor all applicable laws and regulations regarding data transmission and any data collection.

Liability for Content

  1. The exhibitor undertakes to comply with all applicable laws and regulations regarding the content it posts and to monitor such compliance.
  2. Messe Düsseldorf is entitled to check the content posted by exhibitors on the portal for compliance with the law.
  3. Should an exhibitor breach applicable laws or the contract and fail to remedy this breach immediately even after being notified by Messe Düsseldorf, Messe Düsseldorf is entitled to block the access set up for the exhibitor.
  4. Messe Düsseldorf accepts no liability for content posted by
    exhibitors. This also applies where the exhibitor provides links to external sites.
  5. The exhibitor is obliged to inform users that the exhibitor bears sole responsibility for the content they post and that Messe Düsseldorf is not liable for it.
  6. The exhibitor indemnifies Messe Düsseldorf against any liability for content posted by the exhibitor. Messe Düsseldorf shall be liable to the extent that this cannot be excluded by law.
  7. The exhibitor undertakes to comply with so-called netiquette. This means that the exhibitor will observe all rules established in relation to online behaviour.
  8. The exhibitor declares that they comply with all applicable export laws relating to the transfer of technical data exported from the country in which the exhibitor is based.

Contract term/termination

The exhibitor shall have access to the aforementioned usage options for a maximum of three months prior to the next event, commencing from the date on which Messe Düsseldorf GmbH first publishes exhibitor data on this portal. Messe Düsseldorf GmbH reserves the right to change this date should technical developments make this absolutely necessary.

Final provisions

  1. The place of performance and venue for legal proceedings is Düsseldorf.
  2. No ancillary agreements, including verbal ones, have been made in relation to this contract. Any amendments or additions to this contract must be made in writing. This also applies to amendments to this written form clause.
  3. Messe Düsseldorf is entitled to send information and notifications relating to the contract to the exhibitor’s email address. Such notifications shall be deemed to have been received once they can be retrieved from the exhibitor’s email inbox, irrespective of the date on which the exhibitor actually retrieves such notifications.
  4. Should any individual provisions of this contract be or become invalid, the remaining provisions shall remain unaffected. Any gaps that may arise shall be filled in such a way as to preserve the spirit and purpose of the contract.
  5. The contract is governed by the law of the Federal Republic of Germany. The German text is binding.
